Devclouds shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from Customer or Devclouds Web Hosting's server. Customer agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.
We collect information from you in order to deliver services that you purchase and to monitor and improve the customer experience on our website. The data collected may include your name, email address, postal address, telephone number(s), billing information such as credit card numbers, and answers to security questions that help us to verify your identity and secure your account. It may also include marketing preferences, survey and contest responses, and information you provide through online chats, telephone calls, and support tickets with us. Devclouds services are intended for business use, and Devclouds does not knowingly market to or collect personal information from people under the age of 18.
Devclouds collects personally identifiable information in a variety of ways, including but not limited to: online order forms, online chats, telephone calls, market research surveys, and customer support tickets.
Certain information about your computer hardware and software may also be automatically collected through tools such as Google Analytics. This information can include your IP address, browser type, domain names, access times, and referring website addresses.
Devclouds may also collect information from third parties as required in order to provide you with products and services.
Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Devclouds’s blog or social media pages, this information may be collected and used by others.
[3.1] Provision of Services: Devclouds collects and uses your personal information to operate the Devclouds website, to deliver the services you have requested, and to inform you of other products or services available from Devclouds and its affiliates. This includes sharing your information with trusted third parties, as explained below.
[3.2] We DO NOT sell any of your personal information: If you elect use a service that provides you the ability to import your personal contacts or related information (i.e. OnePlan Connect), Devclouds will not use this information for commercial purposes except to provide that service.
[3.3] Third-Party Services: Devclouds offers certain products and services in conjunction with or through trusted partners, sponsors, and affiliates (“Third-Party Services”). These services may be available for an additional fee, or they may be included for free or as a portion of a larger bundle of services. In order to properly set up these services (and, where needed, integrate them with any services you may have), we may need to share certain information you have provided to us with these Third-Party Services. For payments or other monetary transactions, Devclouds must share your personal information (specifically your billing information) with our payment processor. In all cases, we share only information that is required to set up and operate these services. Third-Parties are not permitted to use, keep, or share your data except for the specific services they have been contracted to provide.
[3.4] Business Continuity: Should Devclouds become part of a merger, acquisition, corporate reorganization, or any other change of control, your personal information will be included in Devclouds’s sale of business assets. This means that it could be shared with Devclouds’s new owners, or with a new business that Devclouds acquires. If this happens, Devclouds will make reasonable efforts to notify you and inform you of any choices you may have about the information you shared with us.
[3.5] Web Analytics: Devclouds keeps track of the websites and pages our customers visit within Devclouds in order to determine which Devclouds services are the most popular. This data is used to deliver customized content and advertising within Devclouds to customers whose behaviour indicates they are interested in a particular subject area. Data may also be used to determine the effectiveness of promotional campaigns and advertising.
[3.6] Domain Registration: In order to register domain names, personal information collected during your purchase must be provided to the registrar responsible for processing your request, as per the registrar’s rules and the rules set out by the Internet Corporation for Assigned Names and Numbers (ICANN) and/or the relevant domain name registry.
This information goes into a searchable database (WHOIS). Access to WHOIS information may be limited but you can help protect yourself by opting out of displaying your personal information through the purchase of a Domain Privacy service (some domains are not eligible for this service).
Devclouds secures the information we collect on servers in a controlled, secure environment. We maintain safeguards to protect against unauthorized access, use, modification, and disclosure of this data.
Where possible, Devclouds uses industry-standard SSL encryption when communicating your data. Devclouds also ensures that all customer websites have free access to SSL certificates from“Let’s Encrypt.”
However, no data transmission over the Internet or wireless network can be guaranteed 100% secure. While we strive to protect your personal information, there are security and privacy limitations of the Internet which are beyond our control. Information and data may be viewed or tampered with in transit by a third party, despite best efforts.
[1] Bandwidth pricing and measurement frequency are subject to change at Devclouds's discretion. Customers affected by such changes will be notified no less than thirty (30) days in advance by Devclouds.
[2] Devclouds is under no obligation to compensate Customer for downtime, whether the downtime is caused by Customer, Devclouds, or Devclouds's upstream providers.
[3] Customer agrees that dedicated server payments are NONREFUNDABLE. For example, if Customer submits payment for twelve (12) months of service, service will be provided for twelve (12) months and will not be refunded if Customer chooses to discontinue service with Devclouds mid-way through the term. DreamCompute services will be billed on a monthly basis; existing DreamCompute customers may remain on a pre-paid billing plan, but new customer accounts will be subject to a usage-billing plan. Termination or upgrades of DreamCompute services will result in the following refund and billing procedures:
[3.1] Pre-Paid Billing DreamCompute Plan: Any termination or upgrade will result in a refund of the prorated value of the plan for the last billing period.
[3.2] Usage-Billing DreamCompute Plan: Any termination will result in the customer being billed for usage, rounded up to the nearest hour.
[4] Hardware upgrades to an existing 'platform' (platform defined as a motherboard/chassis combination) will be performed by Devclouds and shall incur an additional one-time labor fee of $100 as well as an increase to Customer's standard monthly rate.
[5] Any hands-on labor necessitated by the customer (including, but not limited to, re-installing the operating system on the server) shall be performed by Devclouds and shall incur an additional one-time labor fee of $100 for each incident.
[6] Devclouds reserves the right to alter the dedicated server packages advertised on its website at its discretion. Devclouds is not required to upgrade Customers' hardware or bandwidth allocation as a result of a pricing or service package change. There will be an additional charge of $200 associated with any such hardware upgrade requested by Customer. Customer will not be required to upgrade hardware as a result of a pricing change.
[7] For managed servers, Devclouds is responsible for the security of the network, the kernel, and the base operating system (defined as the standard set of debian packages that come installed with the server). Devclouds may take any steps it deems necessary at any time to protect the security of your server (this generally includes applying security patches as well as upgrading the entire operating system).
[8] For unmanaged servers not using a "DreamCatcher" monitoring option, Customer is responsible for keeping the security of their system up to date. This includes but is not limited to the following requirements:
[8.1] The kernel will be patched within 7 days of any announced security hole relating to the kernel.
[8.2] Any security patches for all installed software must be applied within 7 days of their general announcement to the security community at large.
[9] Devclouds is not responsible for notifying unmanaged servers of the need to apply patches. Failure to comply with these requirements is grounds for termination of contract without refund. Devclouds reserves the right to take any action upon unmanaged dedicated servers it deems necessary at any time to protect the security and integrity of Devclouds's network.
[1] Devclouds guarantees 100% uptime. A failure to provide 100% uptime will result in customer compensation pursuant to guidelines established herein.
[2] Customer is entitled to compensation if Customer's web site, databases, email, FTP, SSH or webmail become unusable as a result of failure(s) in Devclouds systems for reasons other than previously announced scheduled maintenance, coding or configuration errors on the part of the Customer.
[3] Customer will receive Devclouds credit equal to the Customer's current hosting cost for 1 (one) day of service for each 1 (one) hour (or fraction thereof) of service interruption, up to a maximum of 10% of Customer's next pre-paid hosting renewal fee.
[4] Devclouds's assessment of downtime begins when Customer opens a support ticket to report the problem.
Devclouds uses “cookies” to help personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize Devclouds pages, or register with a Devclouds site or service, a cookie helps Devclouds recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Devclouds website, the information you previously provided can be retrieved, so you can easily use the Devclouds features that you customized.
Some cookies are necessary for Devclouds sites to work properly, such as the cookies which indicate you’ve successfully logged into your account. Some cookies, like the ones used by Google Analytics, help us see how visitors use our sites. Others are used to customize your advertising experience. If you visit a Devclouds website with a browser that has cookies enabled, you are letting us know that you agree to us using cookies with your browser.
